የተፈጥሮ ሕግ ለምን አይሻሻልም?

* ከተፈጥሮአዊ ህጋዊ እይታ አንጻር የህግ አወጣጣችንን ለመዳሰስ የቀረበ ጹሑፍ

መግቢያ #ethiopia | የተፈጥሮ ህግ (Natural Law) ከሰው ልጅ ታሪክ፣ ስልጣኔና ፖለቲካዊ ውሳኔዎች ቀድሞ የነበረ፣ አጽናፈ-ዓለምና የሰው ልጅ ህልውና የሚመሩበት ዘላለማዊ ሰንሰለት ነው። የሰው ልጅ ማህበራዊ ኑሮውን ለመምራት ህጎችን ያወጣል፣ ይሽራል፣ ያሻሽላል። ነገር ግን የተፈጥሮ ህግ ጊዜ የማይሽረው፣ ቦታ የማይወስነውና በፍጹም የማይሻሻል ፍጹም እውነት ነው። ይህ ጽሑፍ የተፈጥሮ ህግ ለምን ሊሻሻል እንደማይችል፣ በሳይንስ፣ በሃይማኖትና በጥንታውያን ፈላስፋዎች እይታ መርምሮ፣ እኛ ሰዎች በህግ አወጣጥ ሂደታችን ውስጥ ምን መማር እንዳለብን በጥልቀት ያብራራል።

ዋና ዋና አንኳር ይዘቶች
1. ፍጹም ንጽህና፣ ፍጹም እውቀትና የህግ ምንጭ
በፍልስፍና እይታ ህግን ለመደንገግ ፍጹም ንጽህና (ከራስ ወዳድነትና ከጥቅም ግጭት የጸዳ እውነት) እና ፍጹም የበሰለ እውቀት ያስፈልጋል። ይህ ፍጹም ንጽህናና እውቀት ደግሞ የሁሉም ነገር ፈጣሪ የሆነው የአምላክ መገለጫ ነው። የተፈጥሮ ህግ ምንጩ ፍጹም የሆነው መለኮታዊ ጥበብ በመሆኑ መሻሻል አያስፈልገውም። እኛ ሰዎች ግን ማህበራዊ ህጎችን ስናወጣ ፍጹም ንጽህና (ከቡድንና ከግል ጥቅም የጸዳ) እና የበሰለ እውቀት (የማህበረሰቡን ስነ-ልቦና፣ ታሪክና የወደፊት እጣ ፈንታ ያገናዘበ) ሊኖረን እንደሚገባ የተፈጥሮ ህግ ያስተምረናል። ፍጹም እውቀት ሳይኖር የሚወጣ ህግ ሁልጊዜም ጎደሎና ተሻሻይ ነው።

2. የኮስሞስ ምስክርነት እና የተፈጥሮ ህግጋት መገለጫዎች
የተፈጥሮ ህግጋት የማይለወጡና የማይደክሙ መሆናቸውን በዙሪያችን ባለው ዓለም በተግባር እንረዳለን፡

• የፀሐይ ብርሃንና ኃይል፦ ፀሐይ በየቀኑ የምትሰጠው የብርሃንና የሙቀት ኃይል መቼም ቢሆን አያልቅም። ይህ ጽኑ ህግ ማሻሻያ አያስፈልገውም።

• ብርሃን፣ ጨለማና የፀሐይ ዙረት፦ መሬትና ፕላኔቶች በፀሐይ ዙሪያ የሚያደርጉት ስልታዊ ዙረት የቀንና የሌሊት (የብርሃንና የጨለማ) ኡደትን ይፈጥራል። ይህ የስነ ፈለክ ህግ ሳይዛነፍ ለዘመናት የጸና ነው።

• የህይወት ኡደት (መወለድ፣ መኖር፣ መሞት)፦ ማንኛውም እንስሳም ሆነ እጽዋት ይወለዳል፣ ይኖራል፣ ይሞታል። የእነሱ የእንትንፋስና የህልውና ህግ ማንም ሰው ሊሽረው የማይችል የተፈጥሮ ዑደት ነው።

3. የሳይንስ ህግጋት ጽኑነት (ፊዚክስ፣ ኬሚስትሪና ባዮሎጂ)
በሳይንስ ዓለም ውስጥ የምናገኛቸው ህጎች የሰው ልጅ የደረሰባቸው የተፈጥሮ እውነታዎች እንጂ ሰዎች የፈጠሯቸው አይደሉም። ለዚህም ነው የማይሻሻሉት፡

• የፊዚክስ ህግ (የኃይል ጥረት ህግ)፦ በፊዚክስ ትልቅ ስፍራ ያለው ህግ "ኃይል (ኢነርጂ) አይፈጠርም፣ አይጠፋምም፤ ከአንድ ቅርጽ ወደ ሌላ ቅርጽ ይለወጣል እንጂ" (Energy is neither created nor destroyed, it can only be transformed from one form to another) ይላል። ይህ ህግ ከዘላለም እስከ ዘላለም የማይሻሻል የተፈጥሮ እውነት ነው።

• የኬሚስትሪና ባዮሎጂ ህግጋት፦ ውሃ ሁልጊዜ ከሁለት ሀይድሮጅንና ከአንድ ኦክስጅን (H₂O) ይፈጠራል። የሰው ልጅ ስነ-ህይወታዊ (Biological) መዋቅር፣ የደም ዝውውርና የሴሎች ኡደት በተመሳሳይ ጽኑ ህግ የሚመሩ ናቸው። እነዚህ የሳይንስ ህጎች የሰው ልጅ ህግጋት ምን ያህል ደካማና ተለዋዋጭ እንደሆኑ ትልቅ ማስረጃዎች ናቸው።

4. "አዳም አትብላ"፦ የመጀመሪያው ህግ፣ ሞት፣ ካሳ እና ህይወት
በትዕዛዝ ደረጃ ለመጀመሪያ ጊዜ የተሰጠው ህግ ለአዳም የተቀመጠው "ይህን ዕፅ አትብላ፣ ሌላውን ግን ብላ" የሚለው መለኮታዊ ህግ ነበር። ይህ ክስተት የህግን መዋቅር ፍልስፍናዊ በሆነ መንገድ ያሳያል፡

• ህግ (Law)፦ ድንበርንና ክልከላን ያስቀምጣል። "አትብላ" መባሉ የህግ የበላይነትን ያሳያል።

• ሞት (Death)፦ ህግ ሲጣስ የሚመጣውን ፍጹም ቅጣትና ውጤት ያመለክታል። አዳም ህጉን በመጣሱ ምክንያት ሞት ወደ ዓለም ገባ።

• የሞት ካሳ (Compensation for Death)፦ ፍትህ መዛባትን አትፈቅድም። ለተፈጠረው ጥፋትና ሞት ተመጣጣኝ የሆነ የካሳ ወይም የቤዛነት ህግ አስገዳጅ ሆነ።

• ህይወት (Life)፦ ከካሳውና ከፍትህ መረጋገጥ በኋላ የሚመጣውን አዲስ ተስፋና ህይወትን ያሳያል። ይህ ዑደት ህግ የራሱ የሆነ የውጤትና የፍትህ ሚዛን ማስጠበቂያ ሰንሰለት እንዳለው ያስገነዝበናል።

5. የሰው ልጅ ህግጋት ተለዋዋጭነት (የምዕራባውያን አገራት ማሳያ)

ከተፈጥሮ ህግ በተቃራኒ፣ በሰዎች የሚወጣ ህግ ሁልጊዜም ተለዋዋጭ ነው። የሰዎች ህግ የመንግስታት ስልጣን በየጊዜው ሲቀያየር፣ የመሪዎች ወንበር ሲናወጥና እንደየአስፈላጊነቱ አብሮ ይለወጣል። ለአብነት ያህል የታላላቅ ምዕራባውያን አገራትን ህግ መመልከት ይቻላል፡

• የአሜሪካ ህግ (United States)፦ የአሜሪካ ህገ-መንግስት ከተረቀቀ ጀምሮ እስካሁን ድረስ ከ27 ጊዜ በላይ ማሻሻያ (Amendments) ተደርጎበታል። ይህም የሰዎች ህግ ፍጹም ባለመሆኑ በየጊዜው መታረም እንዳለበት ያሳያል።

• የካናዳ ህግ (Canada)፦ የካናዳ የህግ ስርዓትም እንደ ማህበረሰቡ የኢኮኖሚና የፖለቲካ ፍላጎት በየጊዜው ማሻሻያዎችንና አዳዲስ አዋጆችን ያወጣል።

• የእንግሊዝ ህግ (United Kingdom)፦ እንግሊዝ ያልተጻፈ ህገ-መንግስት ያላት አገር ስትሆን፣ ህጎቿ እንደ ፓርላማውና እንደ ገዢው ፓርቲ ፍላጎት በየቀኑ ሊለወጡና ሊሻሻሉ ይችላሉ።

እኛ ሰዎች በህግ አወጣጥ ምን እንማር?

የሰው ልጅ ህግ አውጪዎች ከተፈጥሮ ህግ መማር ያለባቸው ዋናው ቁምነገር፡ ህግ ለጊዜያዊ የፖለቲካ ጥቅም ወይም ለስልጣን ማራዘሚያ የሚሆን ሳይሆን፣ እንደ ተፈጥሮ ህግጋት ሁሉ ትውልድ ተሻጋሪ፣ ፍትሃዊ፣ ተገማችና ሚዛናዊ መሆን እንዳለበት ነው። ህግ ሲወጣ በጥልቅ እውቀትና ከግል ጥቅም በጸዳ ንጽህና መሆን አለበት። ከተፈጥሮ ህግ (ከሞራልና ከፍትሃዊነት) የራቀ ሰው ሰራሽ ህግ ህግ ሳይሆን የጭቆና መሳሪያ ነው።

ማጠቃለያ
የተፈጥሮ ህግ የማይሻሻለው አስቀድሞ ፍጹም፣ ፍትሃዊና ሚዛናዊ በሆነው መለኮታዊ እውቀትና ንጽህና ስለተሰራ ነው። የሰው ልጅ ህግ ግን የመንግስታት መቀመጥና መነሳት፣ የሰዎች ፍላጎት መቀያየር የሚወስነው ተለዋዋጭ ሂደት ነው። የህግ ባለሙያዎችም ሆኑ ማህበረሰቡ ህግን ሲያወጡና ሲተገብሩ፣ ከተፈጥሮ ህግጋት በስተጀርባ ያለውን ፍጹም ንጽህና፣ የበሰለ እውቀት፣ ተገማችነትና ፍትሃዊነት እንደ መርህ በመውሰድ፣ የሰዎች ህግም ለዘላቂ ትውልድና ለፍትህ መከበር የሚቆም እንዲሆን ማድረግ ይኖርባቸዋል።

ማጣቀሻዎች
• ቅዱስ መጽሐፍ (መጽሐፍ ቅዱስ)፦

o "ሰማይና ምድር ያልፋሉ፥ ቃሌ ግን አያልፍም" (ማቴዎስ 24:35) — መለኮታዊና የተፈጥሮ ህግጋት የማይለወጡ መሆናቸውን ያሳያል።

o "በገነት ካለው ዛፍ ሁሉ ትበላለህ፤ ነገር ግን መልካምንና ክፉን ከሚያስታውቀው ዛፍ አትብላ..." (ዘፍጥረት 2:16-17) — የመጀመሪያው ህግ፣ ክልከላ እና የሞት ውጤት ምሳሌ።

• ቅዱስ ቁርዓን፦

o "በአላህ የፍጥረት ህግ ላይ ምንም ለውጥ አታገኝም፤ ይህ ቀጥተኛው ሃይማኖት ነው" (ሱረቱ አል-ሩም 30:30) — ፍጥረት የተገነባበት የተፈጥሮና የመለኮት ህግ ጽኑና የማይቀየር መሆኑን ያስረዳል።

• የትላልቅ ሰዎች ፍልስፍና፦

o ሶክራትስ (Socrates)፦ ህግ ከጽንሰ-ሃሳባዊ ፍትህና ከሞራል እሴት መነጨት እንዳለበትና ፍጹም እውቀትን መፈለግ የህግ መሠረት መሆኑን አስተምሯል።

o ፕላቶ (Plato)፦ "ሪፐብሊክ" (The Republic) በተሰኘው መጽሐፉ ላይ አገሪቱን የሚመሩና ህግ የሚያወጡ ሰዎች ጥበብና የበሰለ እውቀት ያላቸው "ፈላስፋ ነገሥታት" (Philosopher Kings) መሆን እንዳለባቸውና ይህም የህግን ንጽህና እንደሚያስጠብቅ ገልጿል።

o አሪስጣጣሊስ (Aristotle)፦ የተፈጥሮ ፍትህ (Natural Justice) በሁሉም ቦታ እኩል ኃይል አለው፣ ሰዎች ስላጸደቁት ወይም ስላልተቀበሉት አይለወጥም በማለት የሰው ልጅ ህግ ከተፈጥሮ ህግ ጋር መጣጣም እንዳለበት ተከራክሯል።

በመላው አለም በጡረታ ዕድሜ ክልል ውስጥ የሚገኙ ዜጎች ቁጥር ከ830 ሚሊዮን በላይ እንደሆነ ድርጅቱ ገልጿል።

በአብዛኞቹ የዓለም ሀገራት መደበኛ የጡረታ ዕድሜ ከ60 እስከ 65 አመት እንደሆነ ተቀምጧል።

በአሁኑ ወቅት በዓለም አቀፍ ደረጃ ዕድሜያቸው ከ65 ዓመት በላይ የሆኑ ሰዎች ቁጥር 830 ሚሊዮን እስከ 850 ሚሊዮን ይጠጋል ይህም ከአለም አጠቃላይ ህዝብ 10 በመቶ ያህሉን ይይዛሉ።

ዕድሜያቸው ከ60 አመት በላይ የሆኑ ዜጎች ቁጥር 1.1 ቢሊዮን ይደርሳል።

ከዚህ ቁጥር ውስጥ የጡረታ ገቢ እያገኙ የሚኖሩ ዜጎች ቁጥር 700 ሚሊየኖቹ ብቻ ናቸው።

ቀሪዎቹ በተለይ በታዳጊ ሀገራት ያሉ የጡረታ እድሜ ላይ ቢደርሱም የጡረታ አበል ስለሌላቸው በቤተሰብ ድጋፍ ወይም እስከ እርጅናቸው መጨረሻ ድረስ ሥራ በመሥራት ይኖራሉ ብሏል።

Rural Connectivity: Empowering Communities and Bridging the Digital Divide!

Ethio telecom has successfully completed the first year of its Next Horizon: Digital & Beyond 2028 Strategy, marking significant progress in bridging Ethiopia’s digital divide. At the heart of this strategy is our commitment to inclusive, sustainable and transformative rural connectivity, ensuring that geography, distance and limited access to electricity do not prevent communities from participating in the digital economy.

During the fiscal year, we deployed 195 new rural mobile sites, reaching communities located, on average, 14.3 kilometres from the nearest town and 10.6 kilometres from the nearest existing mobile site. This demonstrates our deliberate focus on connecting Ethiopia’s most remote and underserved areas.

This expansion extended connectivity and digital access to 117 woredas and 492 kebeles and villages, enabling more than 1.53 million people to benefit from reliable communications, digital platforms and inclusive financial services.

To address power limitations in remote areas, we deployed 22 additional Rural Solution sites, specifically designed to serve communities with limited or no access to the national electricity grid. We also significantly expanded our green energy infrastructure, increasing installed solar power capacity from 27 MW to 39.72 MW, an additional 12.72 MW in just one year. This investment strengthens network resilience, reduces dependence on conventional energy sources and advances our environmental sustainability commitments.

Connectivity must also translate into meaningful access to essential services. Through our Rural Agent Project, we onboarded 812 new agents across 17 regions, achieving a 58% active-agent rate and bringing telebirr and other essential digital financial services closer to previously underserved communities. Going forward, we will focus on further improving agent activation, productivity and service availability.

We also advanced the fiberization of rural wireless sites, strengthening network capacity, reliability and service quality while preparing rural communities for growing digital demand.

በትምህርት ያልገፉና የሥራ ልምድ የሌላቸው ወጣቶች በክህሎት ማነስና በራሳቸው ሥራ ለመጀመር በሚገጥማቸው የፋይናንስ ችግር የሥራ ዕድል ዕጦት እንደሚያጋጥማቸው፣ የዓለም የሥራ ድርጅት (ILO) ገለጸ፡፡

የዓለም የሥራ ድርጅት ከሴቶችና ማኅበራዊ ጉዳይ ሚኒስቴር፣ ከዩናይትድ ኪንግደም ተራድኦ ድርጅት (ዩኤአይድ) እና ከሌሎች ተቋማት በጋራ በመሆን፣ በማኅበራዊ ጥበቃ ላይ ያዘጋጀውን ሪፖርት ይፋ ሲያደርግ ነው ይህንን የገለጸው፡፡በሪፖርቱ መሠረት ቁጥራቸው እያደገ ያለው ሥራ ፈላጊ ወጣቶች፣ በክህሎት ክፍተትና የራስን ቢዝነስ ለመጀመር በሚገጥማቸው የፋይናንስ ዕጦት ከፍተኛ ተግዳሮት ይገጥማቸዋል፡፡

የሕፃናት ቁጥር በከፍተኛ ሁኔታ መጨመር ወደ ሥራ ሊገባ የሚገባውን የወጣት ቁጥር የሚያሳድገው በመሆኑ፣ ዕድገቱን ከከተሞች የሥራ ገበያ ዕድል ጋር አጣጥሞና አዋህዶ መሄድ ከፍተኛ ፈተና ይሆናል ብሏል፡፡
በአገር አቀፍ ደረጃ የአካል ጉዳተኞች ቁጥር 17.6 በመቶ እንደሚደርስ ጠቅሶ፣ አካታችና ሁሉን አቀፍ የኢኮኖሚና የማኅበራዊ ተሳትፎን የሚደግፉ ፖሊሲዎችና መሠረተ ልማቶችን ማስፋፋት እንደሚያስፈልግ ገልጿል፡፡

በአገር አቀፍ ደረጃ ለሥራ ብቁ የሆነው የሕዝብ ቁጥር እ.ኤ.አ. በ2015 ከነበረበት 54.7 ሚሊዮን እ.ኤ.አ. በ2025 74.8 ሚሊዮን፣ እ.ኤ.አ. በ2030 ወደ 85.3 እንደሚደርስ ሪፖርቱ ያመለክታል፡፡

ያለአንዳች ደመወዝ የሚሰራ፣ ነዳጅ የማይጠይቅ፣ ነገር ግን በቢሊዮኖች የሚቆጠር ሀብት በማዳን የሀገርን ሸክም የሚያቀል ግዙፍ የኢኮኖሚ ሞተር አለ ብንልዎስ? ይህ ከርህራሄና ከሰብዓዊነት ካባ ጀርባ የማክሮ ኢኮኖሚውን መዋቅር በፀጥታ እያንቀሳቀሰ የሚገኘው ‘የበጎ ፈቃድ አገልግሎት’ እውነተኛ ገፅታ ነው፡፡

የበጎ ፈቃድ አገልግሎትን ስናስብ፣ አእምሯችን ቀድሞ የሚስለው የበጎ አድራጎትን ሰብዓዊነት ቢሆንም በዘመናዊ የምጣኔ ሀብት እሳቤ ግን ይህ ዘርፍ በቀጥታ በሀገር ጠቅላላ ምርት (GDP) ውስጥ ያልተካተተ ግዙፍ "የህዝብ ካፒታል" ነው።

የዓለም አቀፉ የሰራተኞች ድርጅት (ILO) እና የተባበሩት መንግስታት ሪፖርቶች እንደሚያረጋግጡት የበጎ ፈቃድ ዘርፍ መንግስታት ሊያወጡት የሚችሉትን በጀት የሚተካ እና በመንግስትና በግሉ ዘርፍ መካከል ያለውን ክፍተት የሚሞላ ከፍተኛ የኢኮኖሚ ሞተር ሆኖ እያገለገለ ይገኛል።

ሀገራችን ኢትዮጵያ ለዚህ ጥልቅ እሳቤ ባዳ አይደለችም፤ ማህበረሰባችንን ለዘመናት አስተሳስረው ያቆዩት እንደ ደቦ፣ እድር እና እቁብ ያሉ ሀገር በቀል የትብብር ተቋማት የዚሁ ማህበራዊ ካፒታል መገለጫዎች ናቸው።

ኖርጂያን ‘ዱግናድ’ በሚሉት የትብብር ባህላቸው እንዲሁም አሜሪካና ካናዳ በቢሊዮን ዶላሮች በሚገመት የዜጎቻቸው ነፃ አገልግሎት የፈጠሩትን የኢኮኖሚ አቅም፣ እኛም ዛሬ በራሳችን ዐውድ እና ጥበብ በተግባር እያሳየነው እንገኛለን።

በተለይም ከ2010 ዓ.ም ወዲህ "የመደመር ትውልድ" በሚለው ሀገራዊ እሳቤ አማካኝነት ይህ ዘርፍ መሰረታዊ እና መዋቅራዊ ለውጥን አስተናግዷል።

ያለፈውን ስብራት የመጠገን፣ ያለውን የማፅናት እና የነገውን አቅም የመገንባት ጥልቅ ትልም በበጎ ፈቃድ አገልግሎት ውስጥ በተግባር ሲተረጎም በመንግስት አቅም ብቻ ሊሸፈን የማይችለውን ግዙፍ የልማት ክፍተት በመድፈን ተጨባጭ ማክሮ-ኢኮኖሚያዊ ትርጉም አምጥቷል።

በየዓመቱ በአማካይ ከ20 እስከ 25 ሚሊዮን ዜጎች በሚሳተፉበት በዚህ ሀገራዊ ንቅናቄ የተገኙት ውጤቶች በገንዘብ ሲተመኑ ሀገርን የታደጉበት መጠን እጅግ አስገራሚ ነው። ለአብነት ያህል በክረምት ወራት በተከናወኑ የአቅመ ደካማ ቤቶች እድሳት ስራዎች ከ30 ቢሊዮን ብር በላይ የሚገመት የመንግስት የኮንስትራክሽን እና የማህበራዊ ዋስትና በጀት መታደግ ተችሏል።

ከዚህም ጋር ተያይዞ ከ2011 ዓ.ም ጀምሮ በተተገበረው የአረንጓዴ አሻራ መርሃ-ግብር ከ48 ቢሊዮን በላይ ችግኞች በዜጎች ነፃ ጉልበት በመትከልና በመንከባከብ በዋጋ ሊተመን የማይችል ግዙፍ ሀብት ተፈጥሯል።

ይህ መነቃቃት በጤናውና በትምህርት ዘርፉም ደማቅ አሻራ አሳርፏል፤ በየዓመቱ ከ300 ሺህ ዩኒት በላይ ደም በመለገስ የህክምና ግብዓት ወጪን ከማዳንም ባሻገር የበርካታ ዜጎች ህይወት የታደገ ሲሆን በሚሊዮን የሚቆጠሩ ደብተሮች፣ የማጠናከሪያ ትምህርቶች እና የቁሳቁስ ድጋፎች ዝቅተኛ ገቢ ያላቸው ቤተሰቦችን ጫና በእጅጉ አቅልለዋል።

የዚህ ሁሉ ሀገራዊ ጥረት ትልቁ ድል፣ የበጎ ፈቃድ ስራ ከ"ክረምት የዘመቻ ስራነት" ተላቆ ዓመቱን ሙሉ የሚተገበር ተቋማዊ ባህል እና የኑሮ ዘይቤ መሆኑ ነው። ይህ ወደ ዘላቂነት የተደረገ ሽግግር ወጣቶች ቋሚ የስራ ልምድ፣ የጊዜ አጠቃቀም እና የአመራር ክህሎት እንዲያገኙ በማድረግ ለስራ ገበያው ብቁ እያደረጋቸው ይገኛል።

ይህ ሂደት በተዘዋዋሪ የስራ አጥነትን ጫና ከማቃለሉም ባሻገር፣ አምራች ኢንዱስትሪዎች እና ተቋማት የሰለጠነ እና ስነ-ምግባር ያለው የሰው ኃይል በቀላሉ እንዲያገኙ ምቹ ሁኔታን ፈጥሯል። ከሚያመነጨው ቁሳዊ ትርፍ በዘለለም፣ የበጎ ፈቃድ አገልግሎት የተለያየ ዳራ፣ ባህል እና እምነት ያላቸውን ዜጎች በአንድ የጋራ ዓላማ በማሰባሰብ "የእኔ" ከሚለው ጠባብ አስተሳሰብ ወደ "የእኛ" ሰፊ ሀገራዊ ማንነት እያሸጋገራቸው ይገኛል።

በዚህ የበጎነት መድረክ አዛውንቶች የህይወት ተሞክሯቸውን ሲያካፍሉ ወጣቱ ደግሞ ጉልበቱንና የዘመኑን እውቀት ይለግሳል፤ ይህ ውብ የትውልድ ቅብብሎሽ ማህበረሰባዊ መተማመንን በማሳደግ በፍትህና ፀጥታ ተቋማት ላይ ያለውን ጫና በእጅጉ ይቀንሳል።

ጠንካራ መተማመን እና ትስስር ያለው ማህበረሰብ ደግሞ ተፈጥሯዊም ሆነ ሰው ሰራሽ ቀውሶችን በጋራ የመቋቋም አቅሙ እጅግ የላቀ ነው።

የኢኮኖሚ እድገት ትክክለኛ ትርጉም እና ጣዕም የሚኖረውም የተሳሰረ እና አንዱ ለአንዱ የሚቆረቆር ጠንካራ ማህበረሰብ ሲኖር ነው። በገንዘብ ሲተመን በቢሊዮኖች የሚገመት ሀብት የፈጠረውን ይህን ግዙፍ ሀገራዊ ካፒታል ይበልጥ ለማሳደግ እና ቀጣይነቱን ለማረጋገጥ ዘመኑ በሚጠይቀው የቴክኖሎጂ ስርአት መደገፍ የግድ ይላል።

ሐሳብን በነጻነት የመግለጽ መብት እና የሕግ የበላይነት!!

መግቢያ፤

​በማንኛውም ዴሞክራሲያዊ ማኅበረሰብ ውስጥ ሐሳብን በነጻነት የመግለጽ መብት እና የፕሬስ ነጻነት የሉዓላዊነትና የነጻነት መገለጫዎች ተደርገው ይወሰዳሉ። በተለይም በመገናኛ ብዙኃን የሚሠሩ ጋዜጠኞች የማኅበረሰቡን ድምፅ በማስተጋባት፣ የመንግሥትን አሠራር በመታዘብና ተጠያቂነትን በማስፈን ረገድ የጎላ ሚና አላቸው።

ይሁን እንጂ የፕሬስ ነጻነትና የብሔራዊ ደኅንነት ሚዛን፣ እንዲሁም በመንግሥት ጸጥታ ኃይሎች የሚወሰዱ እርምጃዎች ከሕገ-መንግሥታዊ ድንጋጌዎች ጋር ያላቸው መጣጣም በተደጋጋሚ ለክርክር የሚዳርግ ጉዳይ ነው።

ይህ ጽሑፍ ማንነትንና ሃይማኖትን ማእከል ባደረጉ ግድያዎችና ማፈናቀሎች ዙሪያ በሠራቻቸው ቪዲዮዎች ከሰሞኑን በቁጥጥር ስር የዋለችውንና ለ10 ቀናት ፍርድ ቤት ያልቀረበችውን የጋዜጠኛ ሣልሳዊት ባይነሳኝ ጉዳይ መነሻ በማድረግ- የኢትዮጵያን ሕገ-መንግሥት እና ዓለም አቀፍ የሰብአዊ መብቶች ስምምነቶችን መሠረት በማድረግ ሙግታዊ ትንታኔ ያቀርባል።

​1. ሐሳብን በነጻነት የመግለጽ መብት ሕገ-መንግሥታዊና ዓለም አቀፋዊ መሠረቶች፤

​የኢፌድሪ ሕገ-መንግሥት በአንቀጽ ፳፱ (29) ላይ ማንኛውም ሰው ያለ ምንም ጣልቃ ገብነት የፈለገውን ሐሳብ የመያዝ፣ የመግለጽና መረጃ የመሰብሰብ እንዲሁም የማሰራጨት መብት እንዳለው በግልጽ ይደነግጋል። ይህ መብት በተለይ የፕሬስ ነጻነትንና የሚዲያ ተቋማትን ሥራ የሚመለከት ሲሆን ሳንሱር በሕግ የተከለከለ መሆኑንም ያረጋግጣል።

​ከዚህ በተጨማሪ ኢትዮጵያ ተቀብላ ያጸደቀቻቸው ዓለም አቀፍ ስምምነቶች ለምሳሌ፤

​የዓለም አቀፍ የሲቪልና የፖለቲካ መብቶች ቃል ኪዳን (ICCPR) አንቀጽ 19፤

​የአፍሪካ የሰዎችና የሕዝቦች መብቶች ቻርተር (ACHPR) አንቀጽ 9፤

​እነዚህ ሰነዶች ሐሳብን የመግለጽ ነጻነት የሰብአዊ መብቶች ሁሉ መሠረት መሆኑን ያስገነዝባሉ። ከንድፈ-ሐሳብ አንጻር እንደ John Stuart Mill ያሉ ምሁራን፤ "የሐሳብ የገበያ ቦታ" (Marketplace of Ideas) በሚለው እሳቤያቸው፤ እውነት ሊገኝ የሚችለው ሐሳቦች በነጻነት ሲንሸራሸሩና ክርክር ሲደረግባቸው ብቻ እንደሆነ ይከራከራሉ።

በመሆኑም ጋዜጠኞች በማኅበረሰቡ ውስጥ ያሉ አስከፊ እውነታዎችን (እንደ ማፈናቀልና ግድያ ያሉ) ይፋ ማድረጋቸው የሙያዊ ኃላፊነትና የሕዝብን መረጃ የማግኘት መብት የማክበር ጉዳይ ተደርጎ ሊወሰድ ይገባል።

​2. የፍጹምነት ወሰን እና የብሔራዊ ደኅንነት ሚዛን፤

​ምንም እንኳን ሐሳብን በነጻነት የመግለጽ መብት መሠረታዊ ቢሆንም ፍጹም (Absolute) አይደለም። የኢፌድሪ ሕገ-መንግሥት አንቀጽ 29(6) እንዲሁም የ-ICCPR አንቀጽ 19(3) መብቱ ገደብ ሊጣልበት የሚችልባቸውን ሁኔታዎች ያስቀምጣሉ።

እነዚህም የሌሎችን መብትና ክብር ለመጠበቅ፤
​ብሔራዊ ደኅንነትን፣ የሕዝብን ሰላምና ጸጥታን እንዲሁም የሕዝብን ጤና ወይም ሥነ-ምግባር ለመጠበቅ ሲባል ነው።

​የሙግት ነጥብ፡- በሀገሪቱ ስሱ የሆኑ የማንነትና የሃይማኖት ጉዳዮችን ይፋዊ የቪዲዮ ምስሎችንና ጽሑፎችን ማጋራት በአንድ በኩል ግልጽነትንና እውነትን ማውጣትን የሚያበረታታ ሲሆን፤ በሌላ በኩል ደግሞ ይዘቶቹ የጥላቻ ንግግርን (Hate Speech) የሚያነሳሱ፣ ወይም ግጭትን የሚቀሰቅሱ ከሆኑ በሕግ ሊጠየቁ የሚችሉበት ዕድል አለ።

ሆኖም ግን ይህ ገደብ ሥራ ላይ ሊውል የሚችለው በሕግ የተደነገገ (Prescribed by Law) አስፈላጊ (Necessary) እና ተመጣጣኝ (Proportional) በሆነ መንገድ ብቻ መሆን እንዳለበት የሰብአዊ መብት ተሟጋቾችና ምሁራን ይከራከራሉ። ጋዜጠኛን ማሰር የመጨረሻ አማራጭ (Ultima Ratio) መሆን ያለበት እንጂ የዜጎችን የመረጃ ፍሰት መግቻ መሣሪያ መሆን የለበትም።

​3. የ48 ሰዓት ሕገ-መንግሥታዊ ግዴታ እና የሕግ የበላይነት መሸርሸር፤

​የዚህ ጉዳይ ዋነኛውና አሳሳቢው ሕጋዊ ጥሰት የሚጀምረው ጋዜጠኛዋ በቁጥጥር ስር ከዋለች በኋላ ከተፈጸመው የአያያዝ ሂደት ነው። የኢፌድሪ ሕገ-መንግሥት አንቀጽ ፲፱ (፫) በግልጽ እንደሚያስቀምጠው፦
​"የተያዙ ሰዎች በቁጥጥር ስር በዋሉ በ48 ሰዓት ውስጥ ፍርድ ቤት የመቅረብ መብት አላቸው። ይህ ጊዜ ተያዙበት ቦታ ወደ ፍርድ ቤት ለመምጣት ከሚያስፈልገው ተገቢ ጊዜን አይጨምርም ነፃነታቸውን እንዳያጡ ለመከላከል ወዲያውኑ ፍርድ ቤት የመቅረብ መብት አላቸው።"
​ይህ ድንጋጌ የፓርላማ ሕግ ሳይሆን፣ የሀገሪቱ የበላይ ሕግ (Supreme Law) ነው። ጋዜጠኛዋ ላለፉት 10 ቀናት ፍርድ ቤት ሳትቀርብ መቅረቷ ይህንን ሕገ-መንግሥታዊ መሠረት በግልጽ የጣሰ ድርጊት ነው።

​ምሁራዊና ተጠየቃዊ ትንታኔ (Theoretic and Philosophical Perspective)፤

​ሐቤስ ኮርፐስ (Habeas Corpus)፦ ይህ መርህ በሕግ ታሪክ ውስጥ ግብረ-ገብነትንና ፍትሕን ለማስፈን ከተቀረጹ ትልልቅ መርሆዎች አንዱ ነው። ትርጉሙም "አካሉን ይዘህ ቅረብ" ማለት ሲሆን አስፈጻሚው አካል (የጸጥታ ኃይሉ) አንድን ዜጋ ያለ ፍርድ ቤት ትዕዛዝ ለረጅም ጊዜ አፍኖ እንዳያቆይ የሚከላከል የነጻነት ጋሻ ነው።

​የሥልጣን ክፍፍል መርህ (Separation of Powers)፦ በቻርለስ ደ ሞንቴስኪው (Montesquieu) ፍልስፍና መሠረት፣ የሕግ አስፈጻሚው አካል (ፖሊስ/ጸጥታ) ሰዎችን የመያዝ ሥልጣን ቢኖረውም የእስሩን ሕጋዊነት የመመርመርና የመወሰን ሥልጣን ሙሉ በሙሉ የሕግ ተርጓሚው (የፍርድ ቤት) ብቻ ነው።

ፖሊስ አንድን ዜጋ ለ10 ቀናት ፍርድ ቤት ሳይልክ ሲያቆይ ራሱን በሕግ ተርጓሚነት ቦታ ላይ እየሰየመ መሆኑን ያሳያል። ይህ ደግሞ ወደ አምባገንነትና ወደ ሕግ አልባነት (Arbitrary Detention) የሚወስድ አደገኛ መንገድ ነው።

​የጸጥታ ኃይሎች የሚዲያ ይዘቱ "የሀገር ደኅንነትን ይነካል" የሚል እምነት ቢኖራቸው እንኳ ያንን እምነታቸውንና ያሏቸውን ማስረጃዎች በ48 ሰዓት ውስጥ ለገለልተኛ ዳኛ አቅርበው የተጨማሪ ምርመራ ጊዜ (Remand) መጠየቅ ነበረባቸው። ይህ ሳይሆን መቅረቱ የእስሩን ሕጋዊነት ሙሉ በሙሉ ጥያቄ ውስጥ የሚጥለውና የመንግሥትን ሕግ የማክበር ግዴታ (Duty to Respect) የሚሸረሽር ነው።

​መደምደሚያ፤

​ጋዜጠኝነት ወንጀል አይደለም ይልቁንም የማኅበረሰብን ሕመም የሚያሳይ መስተዋት ነው። በማንነትና በሃይማኖት ላይ የሚፈጸሙ ግድያዎችንና መፈናቀሎችን ወደ አደባባይ ማውጣት፣ መንግሥት ኃላፊነቱን እንዲወጣ የሚያስገድድ የሕዝብ ድምፅ ሊሆን ይችላል።

የይዘቱ አግባብነትና ሕጋዊነት ጥያቄ ውስጥ የሚወድቅ ቢሆን እንኳ ሊፈታ የሚገባው በሕገ-መንግሥታዊና በሕጋዊ ሥርዓቶች መዋቅር ውስጥ ብቻ ነው።

​አንድን ጋዜጠኛ ለ10 ቀናት ያለ ፍርድ ቤት ትዕዛዝ ማሰር ሕገ-መንግሥቱን መጣስ ብቻ ሳይሆን፣ በሀገሪቱ የዲሞክራሲ ምኅዳር ላይ የፍርሃት ጥላ (Chilling Effect) የሚያሳድር ድርጊት ነው።

መንግሥት የሕግ የበላይነትን ለማስከበር መጀመሪያ ራሱ በሕግ መገዛት አለበት። ስለሆነም ጋዜጠኛዋ በአስቸኳይ ፍርድ ቤት ልትቀርብ ወይም ሕገ-መንግሥታዊ መብቷ ተከብሮ በአፋጣኝ ልትፈታ ይገባል።

ሕግን ለመጠበቅ በሚደረግ ጉዞ ውስጥ ሕግን መጣስ፣ ራሱ ሌላ የሕግ መፍረስን የሚወልድ በመሆኑ ሥርዓቱ ሊታረም ይገባዋል።
